There have been a couple of situations with Holographic Wills that I thought were quite interesting…
There was this one guy who wrote out his will on a wall so they wanted to probate the will. To probate the will they had to bring the wall in to show that the will was handwritten.
A will is easy to do. There’s a statutory will, but requirements have to be met otherwise the court will not accept the will.
What other options do I have for Estate Planning?
Another choice for estate planning is to attempt to do it yourself. Some people choose to go to the internet and download a bunch of forms. Without proper help it is possible that some things may be overlooked, even though they may feel like they have a good estate plan.
There are many potential problems that can happen when Estate Planning is done without professional help such as important paragraphs about your wishes not included, or there might be mistakes in filling out the forms.
The whole area of wills and trusts is usually so foreign to people that even given choices they’re not really getting a full understanding of what their decision does and that’s a problem.
Another problem with the internet forms and handling this process on their own that I want to cover is that I’ve seen people never get around to transferring the title to the house or to the other property into the name of the trust.
