Do I need Estate Plans if I only have a modest estate?
If you have a modest estate and you do not own real estate in the state of California then you can likely do without having a revocable trust. However, if you want to have a say in how your assets are distributed after you’re gone you will want to have a will. If you die without having a will then the state of California has a set of rules that will apply. Creating a simple will does not need to be an elaborate process. Often times people may not feel like they have many assets, but if they own real estate, have a pension and/or cash accounts then in fact a more comprehensive estate plan is needed. Everyone’s situation is different and the Estate Plans you need are based on your particular circumstances.

We often use a flat fee system to create the estate plans of our clients. We offer flat fees in certain situations after we’ve determined what assets are there and we can make a projection about timeline to prepare an estate plan. If there is a lot of special drafting needed, special circumstances or unusual assets then we cannot use our minimum fee schedule or fixed fee schedule for estate planning. An example of unusual assets would be if someone had music rights, copyrights or things of that nature or if there are international assets but we try to use a flat fee system for billing that’s very reasonable and it’s used most of the time.
